A. INTRODUCTION

The Ministry of Agriculture issued a notification on 7 July 2001 which requires animal products importers to produce a sanitary permit at the customs gate before entry into the country. Meat and meat products, eggs, milk and milk products, pet food, embryos, ova or semen and other live stock products from livestock are hit by the notification issued under the 100 year old Live Stock Importation Act, 1898.

The livestock definition covers mules, asses, bulls, calves, bullocks, buffaloes, goats, swine, dogs, cats, poultry, parrots, pigeons, canaries and finches. Only products of livestock animals are in the dispensation. It would seem that fish and other sea food are excluded and their import does not require the sanitary permit. Similarly, only specific parts and products are covered. For example, bones of bovine animals can be imported freely without the permit.

The trade division in department of animal husbandry and dairying will analyse the information contained in the application with reference to the risk posed by the import on the health of the animal and human population of the country. They will use internationally recognised scientific principles with reference to the specific product and the disease situation in the exporting country and India. If the finding in the risk analysis is positive, the trade division is duty bound to reject the permit application. (The actual fact of the threat to the animal and human life in India as evidenced by the state of the actual product at the customs may also be taken into consideration while deciding on the application). Special conditions like pre-shipment certification and quarantine checks at any stage may also be imposed on the consignment. The permit is valid for six months with a provision for a six month extension.

The trader has to give a large amount of detail in the application form, most of which may not be true when the event of actual import takes place. He or she must give the detail of the producer, country and locality where the livestock product was produced and the country from which shipment took place.

The implication of the permit condition for entry is that normal inflows of foods from animal sources will be restricted. The consignments under the sanitary permit system are allowed for import only through the ports of Delhi, Mumbai, Kolkata and Chennai.

Bird flu: There is a ban on import of all type of birds and products from birds imported from Hong Kong China, Honduras, Italy, Laos and Pakistan on account of the outbreak of avian influenza, also known as fowl plague in these countries. The order issued on 16 July 2001 under the Livestock Importation Act, 1898 is valid for six months

B1 PROCEDURE FOR IMPORT OF LIVE STOCK PRODUCTS INTO INDIA

S.O. 419(E). – In exercise of the powers conferred by sub-section (1) of Section 3 and Section 3A of the Livestock Importation Act, 1898 (9 of 1898), and in supersession of the notification vide S.O. 1892(E) dated 31st July, 2008 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), the Central Government hereby prohibits, with effect from the date of publication of this notification,-

(i)   the import into India from all countries in view of Notifiable Avian Influenza (both Highly Pathogenic Notifiable Avian Influenza and Low Pathogenic Notifiable Avian Influenza), the following livestock and livestock products, namely:-

(a)  domestic and wild birds (excluding poultry and captive birds);

(b)  unprocessed meat and meat products from Avian species, including wild birds (except poultry);

(c)  semen of domestic and wild birds (except semen of poultry).

(ii)  the import into India from the countries reporting Notifiable Avian Influenza (both Highly Pathogenic Notifiable Avian Influenza and Low Pathogenic Notifiable Avian Influenza), the following livestock and livestock products, namely:-

(a)  live poultry and captive birds;

(b)  day-old chicks, ducks, turkey and other newly hatched Avian species;

(c)  unprocessed meat and meat products from Avian species, including wild birds;

(d)  hatching eggs;

(e)  egg and egg products (except Specific Pathogen Free eggs);

(f)  unprocessed feathers;

(g)  live pig;

(h)  pathological material and biological products from birds;

(i)   products of animal origin (from birds) intended for use in animal feeding or for agricultural or industrial use;

(j)  semen of poultry:

Provided that the prohibition shall not be applicable on the import of processed pet food containing ingredients of meat and meat products from avian species, pig and products of animal origin (from birds) intended for use in animal feeding:

Provided further that the prohibition shall also not be applicable to the import of pathological materials and biological products for diagnostic and research purpose on specific request:

Provided also further that the import of processed poultry meat shall be allowed after satisfactory conformity assessment of the exporting country.

2.   The prohibition shall be in force for a period of six months from the date of publication of this notification or till such time it is modified or withdrawn, whichever is earlier.

SCHEDULE

Procedure for import of livestock products into India

All live-stock products shall be imported into India subject to the following conditions, namely:-

(1) No live-stock product shall be imported into India without a valid sanitary import permit issued under APF clause (3).

(2) All applications for a permit to import consignments by land, air or sea shall be made in either Form A To , or Form B, whichever is relevant, and sent in triplicate to the Joint Secretary, Trade Division, Department of Animal Husbandry & Dairying, Ministry of Agriculture, Government of India

(3) The sanitary Import permit shall be Issue for Import of live-stock products if, after a detailed import risk analysis, the concerned authorities are satisfied that the import of the consignment will not adversely affect the health of the animal and human populations of this country.

(i) The import risk analysis shall be conduct by the concerned officers of the Department on the basis of internationally recognised scientific principles of risk analysis and the analysis shall be conducted with reference to the specific product and the disease situation prevailing in the exporting country vis--vis the disease situation in India.

(ii) The issue of permits shall be refused if the results of the import risk analysis show that there is a risk of the specific product bringing in one of the more specific diseases, which are not prevalent in the country and which could adversely affect the health and safety to the human and animal populations of this country.

(iii) The import permit shall lay down the specific conditions that will have to be fulfilled in respect of the consignment, including pre-shipment certifications and quarantine checks.

(iv) The permit shall also specify the post-import requirements with regard to quarantine inspections, sampling and testing.

(v) The import permit issued under this clause shall be valid for a period of six months, but can be 1 extended by the concerned authority for a further period of six months, on request from the importer and for reasons be recorded in writing.

(4) All livestock product shall be imported into India through the seaports or Airport located at Delhi, Mumbai, Kolkata and Chennai, where the Animal Quarantine and Certification Services Stations are located.

(5) (i) On arrival at the entry point, the livestock product shall be inspected by the officer-in-charge of the Animal Quarantine & Certification Services Station or any other veterinary officer duly authorised by the Department of animal Husbandry and dairying, Wherever required, in accordance with the specific conditions laid down in the sanitary import permit and with general guidelines issued by the Department of Animal Husbandry and Dairying from time to time.

(ii) After inspection and testing, where ever required, the concerned quarantine or veterinary authority shall accord quarantine clearance for the entry of the livestock product into India or, if required in public interest, order its destruction or its return to the country of origin.

(iii) Where ever disinfection or any other treatment is considered necessary in respect of any livestock product, the importer shall, on his own or at his cost through an agency approved by the Department of Animal Husbandry and dairying, arrange for disinfection or other treatment of the consignment, under the supervision of a duly authorised quarantine or veterinary officer
(6) It shall be the responsibility of the importer:

(a) to bring the live stock product to the concerned Animal Quarantine & Certification Services Station, or to the place of inspection, disinfection or treatment or testing as directed by the Quarantine or veterinary officer duly authorized on this behalf;

(b) to open, repack and load into or unload form the Animal Quarantine Station and seal the consignment, and

(c) to remove them after inspection and treatment or testing, according to the directions of the Quarantine or veterinary officer duly authorized by the Department.

(7) The Central Government may, in public interest, relax any other conditions specified under this Schedule relating to the permit in relation to the import of any live-stock product.

C PROHIBITION ON IMPORT OF BIRDS AND BIRD PRODUCTS

Import into India of the following live-stock and live-stock products shall be prohibited from all countries, in view of notifiable Avian Influenza (both Highly Pathogenic notifiable Avian Influenza and Low Pathogenic notifiable Avian Influenza) :

(a)  domestic and wild birds (excluding poultry and captive birds);

(b)  unprocessed meat and meat products from Avian species including wild birds (except poultry);

(c)  semen of domestic and wild birds (except semen of poultry).

Further, the Central Government also prohibits the import into India from the countries reporting notifiable Avian Influenza (both Highly Pathogenic notifiable Avian Influenza and Low Pathogenic notifiable Avian Influenza), the following live-stock and live-stock products, namely:

(a)  Live poultry and captive birds;

(b)  day old chicks, ducks, turkey and other newly hatched Avian species;

(c)  unprocessed meat and meat products from Avian species including wild birds;

(d)  hatching eggs;
